Welcome to The Highmark Collection. These Terms of Use (“Terms”) are an agreement between you and The Highmark Collection LLC (“The Highmark Collection,” “we,” “us,” or “our”) and apply to your use of this website. By using the site, you agree to these Terms. If you do not agree, please do not use the site.

This website shares information about our short-term rental homes in Asheville, North Carolina and Chattanooga, Tennessee, along with local guides and travel tips, and lets you check availability and book a stay directly with us.

These Terms cover use of the website only. Each reservation is also subject to the rental agreement, house rules, cancellation policy, and payment terms shown or provided during booking. If those booking terms conflict with these Terms, the booking terms control for your stay.

Age requirement. The guest who books a reservation must be at least 25 years old. We may ask for proof of age and may cancel a reservation that does not meet this requirement, as described in the rental agreement.

Direct bookings are processed through Hospitable, our reservation platform, and payments through its payment partners, whose terms may also apply. Bookings made through Airbnb, Vrbo, or other platforms are governed by that platform's terms.

Rates, availability, fees, and taxes are confirmed at checkout. Showing a home or a rate on the site does not guarantee availability until your reservation is confirmed.

We work to keep property descriptions, photos, amenities, and rates accurate and up to date, but details can change and errors can happen. We may correct errors and update information at any time.

Our blog and city guides mention local events, attractions, restaurants, and businesses that we do not own or operate. Dates, prices, and hours can change, so please confirm details directly with the venue before you go. Mentioning another business is not an endorsement, and those businesses do not endorse us.

You agree to use the site only for lawful, personal purposes. You agree not to:

• Make false, fraudulent, or speculative reservations or inquiries
• Copy, scrape, or collect content or data from the site using automated tools
• Interfere with the site's security or operation, or try to access areas you are not authorized to use
• Upload or send anything unlawful, harmful, or that violates someone else's rights

The content on this site, including text, photos, logos, and design, belongs to The Highmark Collection LLC or is used with permission or under license. Some photos are used under Creative Commons licenses and are credited where they appear. You may view and share pages for personal, non-commercial use, but you may not copy, reproduce, or reuse our content for commercial purposes without our written permission.

When you contact us, sign up for updates, or submit information through the site, you confirm that it is accurate and that you have the right to share it. Our Privacy Policy explains how we handle personal information, including our use of cookies, analytics, and advertising tools.

The site includes links to, and tools from, other companies, such as our booking platform, analytics and advertising providers, and local businesses. We are not responsible for their content, policies, or services, and your use of them is at your own risk and subject to their terms.

The site and its content are provided “as is” and “as available.” To the fullest extent allowed by law, we make no warranties of any kind, express or implied, about the site, including that it will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent allowed by law, The Highmark Collection LLC and its owners, team members, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the site or its content. This section does not limit our obligations under a confirmed reservation or any rights you have that cannot be limited by law.

You agree to defend and hold harmless The Highmark Collection LLC and its owners, team members, and partners from claims, losses, and expenses, including reasonable attorneys' fees, that result from your misuse of the site or your violation of these Terms.

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. You agree that any dispute about these Terms or your use of the site will be resolved in the state or federal courts located in Georgia, unless the law requires otherwise. Disputes about a specific reservation are governed by the rental agreement for that stay.

We may update these Terms from time to time. Changes take effect when posted, and the “Last updated” date above shows when they were last revised. Continuing to use the site after changes are posted means you accept the updated Terms.
